The agreement between you and Kitchen 24/7 for delivering on the Kitchen24 Driver app.

These Terms & Conditions ("Terms") govern your access to and use of the Kitchen24 Driver application and related services (the "App") operated by Kitchen 24/7 ("we", "us", "our"). By registering as a delivery partner or using the App, you agree to these Terms and to our Privacy Policy.
By using the App you confirm that you have read, understood and agree to these Terms, which form a binding agreement between you and Kitchen 24/7.
You must be at least 18 years old, legally entitled to work and to operate a delivery vehicle in your jurisdiction, and able to enter a binding contract. You must complete identity and document verification (KYC) and provide accurate, current and genuine documents. We may refuse, suspend or revoke your access if documents are missing, invalid, expired or fraudulent, or if verification fails.
You acknowledge and agree that, to provide the service, the App collects your precise location including in the background while you are online/available or on an active delivery, and shares your live location with the customer and restaurant during that delivery, as described in our Privacy Policy. You may go offline or disable location at any time, but you will not be able to receive or complete deliveries without it.
You agree to act professionally, lawfully and courteously toward customers, restaurants and the public; to comply with all traffic and safety laws; and to maintain a reasonable acceptance/completion and rating standard. Repeated cancellations, no‑shows, unsafe conduct, harassment or fraud may lead to suspension or deactivation.
Your earnings consist of delivery fees, applicable tips and any incentives, less any platform fees, commissions or adjustments described in the App. Earnings accrue to your in‑app wallet and may be withdrawn to your provided payout method subject to minimum thresholds and verification. We may correct errors, reverse amounts obtained through fraud or error, and withhold payouts pending investigation. Incentive programs are subject to their stated rules and may change.
As an independent contractor, you are solely responsible for reporting and paying all taxes, contributions and levies arising from your earnings. We may collect tax information and issue documents where required by law.
You are responsible for maintaining a roadworthy vehicle, a valid driving licence, and any registration, permits and insurance required by law for delivery activity. You bear all costs of your vehicle, fuel, data and device.
You must not: provide false information or documents; manipulate location, orders, earnings or incentives; use bots or unauthorised software; sub‑contract or let another person use your account; discriminate against or harass any person; or use the App for any unlawful purpose.
The App and its content are owned by or licensed to Kitchen 24/7. You receive a limited, revocable, non‑transferable licence to use the App solely to provide delivery services on the platform.
The App is provided "as is" and "as available" without warranties of any kind to the maximum extent permitted by law. We do not guarantee a minimum number of delivery requests, earnings, or uninterrupted availability of the App.
To the maximum extent permitted by law, Kitchen 24/7 will not be liable for any indirect, incidental, special, consequential or punitive damages, or loss of profits or earnings. Our aggregate liability for any claim will not exceed the total payouts made to you in the three months preceding the event giving rise to the claim. Nothing limits liability that cannot be excluded by law.
You agree to indemnify and hold harmless Kitchen 24/7, its affiliates and personnel from claims, damages, losses and expenses arising from your deliveries, your use of the App, your vehicle operation, or your breach of these Terms or applicable law.
We may suspend or deactivate your access for breach of these Terms, failed or lapsed verification, safety concerns, fraud, or where required by law. You may stop using the App and delete your account at any time as described in our Privacy Policy.
These Terms are governed by the laws of [Governing Jurisdiction], and the courts of [Governing Jurisdiction] will have jurisdiction, subject to any mandatory rights under applicable law.
We may update these Terms and will post the revised version here with an updated date, notifying you in the App where required. Continued use after changes take effect constitutes acceptance.
